WHY DO WE NEED YOUR EXPLICIT CONSENT TO USE COOKIES? The AEPD Guide of July 2023, incorporating information and criteria from the European Data Protection Board (EDPB), EU Regulation 2016/679 (GDPR), Articles 5, 6, 7 and 13, and the Spanish Organic Law 3/2018 (LOPDGDD), Article 6, must be interpreted to mean that consent shall only be valid if it is explicit. WHAT ARE COOKIES? Cookies are small data files that are received on the terminal device from the visited website and are used to record certain interactions during website navigation, storing data that can later be updated and retrieved.   • Advertising cookies: Managed by the site administrator or third parties, they allow the analysis of browsing habits to display advertising aligned with the user’s profile. They store information about user behaviour obtained through continuous observation of browsing habits to develop a specific advertising profile.
According to the length of time they remain active:
  • Session cookies: Designed to collect and store data while the user accesses a website or App. They are typically used to store information only necessary for the provision of the requested service and disappear at the end of the session.
  • Persistent cookies: These store data on the terminal that can be accessed and processed for a period defined by the cookie’s controller — from a few minutes to several years. The necessity of using persistent cookies should be evaluated, as privacy risks can be reduced by using session cookies. In all cases, their lifespan should be minimized according to their purpose.
The legal obligations imposed by regulations are twofold: the obligation of transparency and the obligation to obtain the user’s explicit consent for the use of cookies on the website. Possibility of denial of access to the service in the event of refusal of cookies: There may be certain circumstances in which the non-acceptance of the use of cookies prevents access to the website or the total or partial use of the service, provided that the user is properly informed and an alternative, not necessarily free of charge, access to the service without the use of cookies is offered.
